Appellant stands convicted of taking, using and operating, in violation of section 1293-a of the former Penal Law, a red GMC van-type beer truck left by its owner for repairs at a local service station. Appellant first asserts that although he allegedly stole the truck on March 29, 1967, he was not convicted until September 18, 1967, subsequent to the effective date of the new Penal Law, and thus should have been convicted under section 165...
