Defendants, Willis Walton and Charlie White were convicted before the recorder's court for the city of Detroit sitting without a jury of the crime of breaking and entering a business place with intent to commit a larceny therein. MCLA § 750.110 (Stat Ann 1968 Cum Supp § 28.305).
