This appeal arose from a decision adverse to appellant (defendant below) imposing upon him the duty to support his mother, appellee herein, pursuant to the mandate of Acts 1947, ch. 82, § 1, p. 249, Burns Ind. Stat., Anno., § 3-3001, which reads as follows:

"Legal civil duty of children to support parents — Conditions.
