In 1966, Oneal Scoggins, the petitioner and appellant herein, was convicted of first degree robbery and sentenced to a term of twenty to forty-two years as an habitual criminal. He appealed that conviction to this court where the same was upheld in State v. Scoggins, 199 Kan. 108, 427 P.2d 603.
