HALL, Judge.

This is an appeal by plaintiff from a judgment dismissing his suit under the provisions of LSA-C.C.P. Art. 561 for failure of the parties to take any steps in the prosecution or defense thereof for a period of five years.

Plaintiff filed suit on December 31, 1954 against Pittman Construction Company, its surety, Continental Casualty Company and the Housing Authority of New Orleans in which he prayed for judgment in the sum of $30,005.01 balance...
