Defendant was charged in count I of an indictment with violation of Health and Safety Code section 11531 (transporting marijuana on February 10, 1967) and in count II thereof with violation of Health and Safety Code section 11530.5 (possessing marijuana for sale on February 11, 1967).

Defendant pleaded not guilty. Jury trial was waived.

The court commenced hearing a Penal Code section 1538.5 motion to suppress evidence and received testimony...
