OPINION

COLLINS, Chief Justice.

This is an appeal from a denial of a pretrial application for habeas corpus. We affirm the holding of the lower court.

At 6:33 p.m., December 11, 1968, Lamond P. Higbee, owner of the Stockmen's Store in Winnemucca, Nevada, while working after closing hours in an elevated office in the rear of his store, heard glass breaking. He looked up and saw a person entering the store through the broken glass of the front door...
