This appeal arises out of actions allegedly occurring in Detroit on July 23, 1967, the day the infamous "Detroit riots" started. Defendant was subsequently arrested and charged in three separate informations with inciting to riot and rioting, contrary to CLS 1961, § 750.505 (Stat Ann 1954 Rev § 28.773) which reads:
