This is a civil action to recover the sum of $3,100 plus interest and costs which plaintiff claims he loaned to the defendant. The case was heard before a justice of the superior court sitting without a jury. At the conclusion of the plaintiff's presentation of his case, the defendant moved under rule 21 of the rules of civil procedure of the superior court to add the plaintiff's son Philip as a party defendant.
