OPINION

ROBERTS, Chief Justice.

This indictment, charging the defendant with murder, was returned after jurisdiction of the defendant, at the time a juvenile, had been waived by the family court. Because the competency of the defendant to stand trial under this indictment was not determined until sometime in 1965, trial was not had until February 1, 1966. At the conclusion thereof, the jury returned a verdict of murder in the first degree, and in April 1966...
