OPINION

MOWBRAY, Justice.

Appellant Hugh O. Coleman brought an action in the district court against the respondents Bensons to recover a $2000 deposit made for the purchase of a condominium apartment. The trial judge denied Coleman's claim, and he has appealed. We reverse, and remand the case with instructions to enter judgment for Coleman.
