By information filed April 4, 1967, defendant was charged with assault with a deadly weapon with intent to commit murder, in violation of Penal Code section 217. Defendant pleaded not guilty. After a trial by jury, defendant was found guilty of assault with a deadly weapon, a lesser but necessarily included offense.

A probation report was ordered and a psychiatrist was appointed to examine defendant pursuant to Evidence Code section 730...
