For personal injuries resulting from a rear-end collision, on April 18, 1962, of defendant's truck with plaintiff's car, which was stopped at a stoplight, the jury awarded plaintiff $40,000 on his claim, under Count I, of $100,000. Defendant's motion for new trial was sustained because of error in refusing to give two withdrawal instructions requested by defendant:
