OPINION
ROBERTS, Chief Justice.
This is a bill in equity brought to recover damages alleged to have resulted from a breach of contract and to enjoin an alleged continuing breach of that contract. The cause was heard by a justice of the superior court after the adoption of the new rules of civil procedure of that court, and thereafter a judgment was entered for the defendants. The plaintiff thereupon prosecuted an appeal to this court from that judgment....
