On December 3, 1966, the appellant, Charles Edgar Stone, while he was being held in jail in Quay County, New Mexico, under warrant of arrest issued by the state of Nevada charging him with being a fugitive from justice, filed a petition for a writ of habeas corpus to test his detention.
