This is an appeal from a judgment refusing to allow Arthur Carson Rubey, III, whom we will hereafter refer to as appellant, to adopt Michael Lee Kuehn, the issue of the marriage of appellee and Mrs. Rubey. Mrs. Rubey gave her consent to the adoption but appellee refused to give his consent. Appellant, the stepfather, petitioned the court to allow the adoption.
