Defendant, Elmer Danles, was convicted in a jury trial of the crime of breaking and entering the Trinity Lutheran Church of Berrien Springs, Michigan, with the intent to commit a larceny therein, under CL 1948, § 750.110 as amended by PA 1964, No 133 (Stat Ann 1968 Cum Supp § 28.305). Elmer Danles was one of supposedly three participants in the crime.
