Appeal from an order of the district court denying plaintiff's motion for a new trial on the ground of newly discovered evidence.

This suit arose out of a collision between two virtually identical aircraft (1958 and 1959 Cessna 172's) while both were attempting to land at the airport in Madison, Minnesota. The defendant, Gordon Denelsbeck, was alone in his plane and the plaintiff, Bernard Blake, was an instructor...
