Plaintiff, Country Life Insurance Company, brought action for declaratory judgment. It sought a determination that its insured, J. Everett Goffinet, did not die as a result of accidental injuries within the meaning of its insurance contracts. After answer was filed, plaintiff moved to dismiss the suit. This motion was denied. Cause was tried by a jury which returned a verdict in favor of the defendant, Bernadine Goffinet, beneficiary under said contracts...
