This is a jury-waived, court-tried action at law in two counts on two negotiable promissory notes admittedly executed and delivered by defendants Roy A. Hicks and Ada Bell Hicks, husband and wife, to Kold Draft, Incorporated, the payee, which sold and endorsed both notes without recourse to plaintiff Securities Investment Company.
