Defendant has appealed from judgment and sentence following jury verdict of guilty of rape as defined in section 698.1, Code of Iowa.

On January 12, 1967 Ronald Dean Pilcher was indicted for rape. Following his plea of not guilty he was tried, found guilty and sentenced to a term of 50 years imprisonment.
