Carolyn Schaefer brought suit against the City of Athens, alleging that on November 6, 1967, she was injured when she fell on its defective sidewalk, later amending and alleging an additional injury occurring when on March 15, 1968, she developed ascetic necrosis of the left femoral head and that this resulted from the defendant's negligence in maintaining its sidewalk and causing her fall.
