This is an appeal from the Marion Criminal Court, Division Two. Appellant was charged by indictment with the crime of murder in the second degree, Ind. Ann. Stat. § 10-3404 (1956 Repl.) and, after jury trial, was found guilty of manslaughter. Ind. Ann. Stat. § 10-3405 (1956 Repl.).
