KELLEHER, Justice.

This is a civil action1 to recover damages under the theft provision of an automobile insurance policy issued the plaintiff by the defendant insurer. Trial was held in the Superior Court where a jury returned a verdict for the insurer. Thereafter, the Superior Court denied the plaintiff's motion for a new trial and he filed this appeal.
