Pertinent facts and background in this litigation are set forth in the opinion of the District Court of Appeal, Third District.1 We granted certiorari because of the holding in the decision that the trial court should have granted the motion for a judgment notwithstanding the verdict for the plaintiff attorneys because "the preponderance of the evidence was to the effect there were agreed fees"2
