MARBURY, J., delivered the opinion of the Court.

On January 20, 1966, an automobile driven by appellee, Chester Earl Wiles, struck and seriously injured the infant appellant, Ricky Spence. Charles Spence, individually, and as Ricky's father and next friend, brought an action for the damages arising from the child's injuries sustained as a result of the accident.
