By indictment approved by the grand jury on December 5, 1968, defendant was charged with violation of section 102 of the Building Code of the City of Wilkes-Barre, in that he:

". . . on or about July 22, 1968 to on or about August 26, 1968 in said County, did unlawfully alter, repair or add to a building at 141 N. Washington Street, Wilkes-Barre by doing certain construction work...
