Milton Peters was charged by an information with the crime of pimping for Sandra McClenden, a prostitute (Pen. Code, § 266h). He also was charged with and admitted three prior felony convictions. A jury found him guilty as charged. His motion for a new trial was denied; probation was denied; and he was sentenced to state prison.

He appealed from the judgment, contending:
