The first trial of defendant ended in a mistrial for reasons not presently relevant. The second trial resulted in a jury conviction of rape1 and a sentence on November 9, 1966, of 20 to 40 years imprisonment. The defendant has brought this appeal alleging 8 errors of law which will be discussed seriatim following a recapitulation of the essential facts.
