McFARLAND, Justice.

The defendant, David L. Goldsmith, hereinafter referred to as defendant, was convicted in the Superior Court of Maricopa County of the offense of child molesting, a felony, and sentenced on the 26th day of July 1967, to serve a term of not less than one nor more than two years in the Arizona State Prison, to commence March 16, 1967, the date he was first arrested.
