This is an appeal by plaintiff from an order granting defendant's motion for a new trial.

Plaintiff Roseboro, while playing baseball as catcher for the Los Angeles Dodgers, was struck in the eye by a pitched baseball which allegedly went through a face mask worn by him, when the ball was "fouled off" a bat. The mask, which was manufactured by the defendant Rawlings Manufacturing Company, was given to plaintiff by the defendant Rawlings Sporting...
