This cause was conveniently consolidated with a companion case for trial in the Common Pleas Court, and both cases were appealed jointly. However, for the reason that the legal issues in the two cases are totally different, it becomes necessary to consider each case separately on appeal. The plaintiff, Betty Garland, as mother and next friend of Wilbur Garland, a minor, filed an action for false imprisonment against Ross Dustman, the Sheriff of Portage...
