The appellant was the defendant in a suit brought by the plaintiff-appellee in which the plaintiff sought payment for work performed and materials furnished in the construction of an apartment building, pursuant to a written contract between the parties. The complaint alleged that the plaintiff was prevented from completing its contract for the work and materials which it had agreed to supply.
