ANDERSON, J., delivered the opinion of the Court.

The appellant, Morris Fulford, was convicted of setting fire to and burning a schoolhouse in violation of Article 27, Sec. 7, Maryland Code, in a non-jury trial in the Circuit Court for Caroline County. He was sentenced to the jurisdiction of the Department of Correction for a period of nine years.
