Appellant appeals from a denial of his third motion to vacate judgment and sentence made pursuant to CrPR 1.850, 33 F.S.A.

In 1964 appellant was convicted of assault with intent to commit robbery. On appeal appellant argued that he was illegally arrested and that there was insufficient evidence to sustain the conviction. This court affirmed the conviction at 181 So.2d 34.
