Gersmehl was fifty-nine at the time of the trial and lived with his mother on a fifty-eight and one-half acre farm, where he operated a small junk business. In January, 1967, Gersmehl contacted Kermit Krueger, a real estate broker, for the purpose of selling part of his farm.
