Gen. Nos. 52,702, 52,703. (Consolidated.).

108 Ill. App.2d 132 (1969)

246 N.E.2d 817

People of the State of Illinois, Plaintiff-Appellee, v. Melvin Turner (Impleaded), and Wendell Horne (Impleaded), Defendants-Appellants.

Appellate Court of Illinois — First District, Fourth Division.

April 2, 1969.

Attorney(s) appearing for the Case

Gerald W. Getty, Public Defender of Cook County, of Chicago (James J. Doherty, Assistant Public Defender, of counsel), for appellants.

John J. Stamos, State's Attorney of Cook County, of Chicago (Elmer C. Kissane and Oliver D. Ferguson, Assistant State's Attorneys, of counsel), for appellee.

MR. PRESIDING JUSTICE DRUCKER delivered the opinion of the court.

Defendants appeal from their convictions, after a bench trial, of attempt robbery. Both were sentenced to the Illinois State Penitentiary; Horne for a term of one to four years, and Turner for a term of one to five years. Defendants contend that the State failed to prove the essential elements of the crime.1
