In passing upon this question it is elementary that all the evidence which supports the plaintiff's claim must be taken as true and must be considered in the light most favorable to him, resolving all discrepancies and contradictions in his favor and giving him the benefit of every reasonable inference which legitimately may be drawn therefrom.
