Roy Dockery and two co-defendants, Charles Jackson and James Johnson, were convicted of rape (MCLA § 750.520 [Stat Ann 1954 Rev § 28.788]), after a jury trial. This appeal is taken as of right by defendant Dockery.

On the evening of July 2, 1966, on the invitation of defendants, complainant accompanied the three to the apartment of Johnson's uncle to hear Jackson play the bongo drums...
