Herman Burks was found guilty of rape by a jury and was sentenced to the penitentiary for a term of not less than eight years and not more than thirteen years.

He contends that his conviction should be reversed or in the alternative, reversed and remanded, because his identification was insufficient to sustain a finding of guilty; the trial court permitted hearsay testimony concerning his identification...
