Defendant is charged with violating Section 4511.53, Revised Code, in that he failed to wear a protective head gear while driving his motorcycle. Defendant has demurred to the affidavit charging him with such violation on the grounds that, as a matter of law, said statute denies him rights guaranteed under Amendment XIV, United States Constitution, and Section 1, Article I, Ohio Constitution.
