SKELTON, Judge, delivered the opinion of the court:

This is a civilian pay case in which the discharged employee, Richard Schlegel, is entitled to the benefits of the Veterans' Preference Act of 1944, 58 Stat. 387, as amended, 5 U.S.C. § 851 et seq.

Prior to his removal on July 31, 1961, the petitioner had served creditably as a civilian in the Department of the Army, Office of Transportation, in Hawaii...
