The defendant, Edward Eugene Merrill, was tried by jury in the circuit court of Lee County and convicted of the crime of burglary for which he was sentenced to the penitentiary for a term of not less than 5 nor more than 18 years. The judgment of conviction was affirmed by the appellate court (People v. Merrill, 78 Ill.App.2d 355
