Plaintiffs filed complaint herein alleging that the defendants "acting under color of state statute, illegally seized printed material belonging to plaintiffs, to wit, printed copy of the newspaper Pterodactyl, which material is an exercise of plaintiffs' right to freedom of speech and press." Plaintiffs further allege that "the seizure was without warrant and without prior adversary adjudication of obscenity...
