OPINION

The plaintiffs brought this action under the Civil Rights Act, 42 U.S.C. §§ 1981 et seq. to recover compensatory and punitive damages for a beating allegedly administered by agents of the defendant, motivated solely by racial prejudice. The plaintiffs are Negroes. Although the defendant was not a "person" within the meaning of 42 U.S.C. § 1983, we granted leave to proceed in forma pauperis
