ANDERSON, Circuit Judge:

Appellant Steven Wayne Trimm was convicted by a jury of refusing to report for and submit to induction into the armed forces, in violation of 50 U.S.C. App. § 462(a). He was sentenced to four years imprisonment.

Trimm was ordered by his local draft board in Hudson, New York, to report for induction March 12, 1968. He went to the board's office and also to the examining station in Albany, but there he declined to undergo any part...
