Appellant, while serving a sentence for violation of the narcotics act (Uniform Narcotic Drug Act, RCW 69.33), brought an application for a writ of habeas corpus in the superior court seeking a new trial. He appeals the denial of his petition.

In September, 1964, Seattle police officers, following a period of surveillance, arrested appellant and, pursuant to the authority of a search warrant, searched his living quarters. They found there some capsules...
