MERRILL, Circuit Judge:

In this case a panel of this court, by divided vote, reversed the District Court. This court, in banc, then took the case on rehearing. We affirm.

Appellant stands convicted of the transportation of a stolen motor vehicle in foreign commerce in violation of 18 U.S.C. § 2312. On this appeal he contends that he was, without intelligent waiver, deprived of the assistance of counsel.
