Carmen A. Gaston, formerly Carmen A. Jacobson, now deceased, was plaintiff in the trial court and will be so referred to here. This was an action for damages resulting from a fall by plaintiff in the defendant's down-town store. At the conclusion of the plaintiff's case, the defendant moved for a directed verdict.
