The conviction is for the offense of burglary with intent to commit theft; the punishment, seven years.

The sufficiency of the evidence is challenged. Officer Gilmore of the San Antonio Police Department testified that on a Sunday afternoon as a result of a signal from a silent type burglary alarm, he went to the Big State Mercantile Company on Probandt Street in San Antonio.
